A federal judge has given the Trump administration a week's extension to answer questions about the deportation of Kilmar Abrego Garcia. This man was sent back to El Salvador last month due to an "administrative error. " He was deported despite having court protections in place. This extension comes after a stern rebuke from the judge, who accused the administration of not complying with her orders.
The judge, Paula Xinis, had previously criticized the administration's vague and unsatisfying responses to her demands for information. She accused them of trying to obstruct the discovery process. The judge's order was clear: "Defendants have failed to respond in good faith, and their refusal to do so can only be viewed as willful and intentional noncompliance. " The judge rejected the administration's arguments, calling them "specious" and condemning their "mischaracterization" of the Supreme Court's directive.
The White House has been insisting that Abrego Garcia is a member of MS-13, a Salvadoran gang. They have declared MS-13 a Foreign Terrorist Organization. However, Abrego Garcia's lawyers and family dispute this claim. They say the allegation is based on flimsy evidence and note that he has no criminal record. The judge has ordered the administration to provide evidence supporting these claims.
This case has gone through three federal courts, including the Supreme Court. The Supreme Court ordered the administration to "facilitate" Abrego Garcia's release and handle the case as if the improper deportation had never occurred. Despite this, the Justice Department continues to resist. They argue that since Abrego Garcia is now in El Salvador's custody, American courts cannot order his return.
Abrego Garcia entered the U. S. illegally but was granted protection by an immigration judge in 2019. This should have prevented his deportation. He had been living quietly in Maryland with his wife and three children, working in construction. Immigration and Customs Enforcement officers arrested and deported him last month. Lawyers for Abrego Garcia have complained that the government has produced "nothing of substance" in response to the court-ordered discovery process. They say the government has repeatedly refused to answer questions, citing what they call the "false premise" that the administration must facilitate his release.
The case is part of a broader legal battle involving more than 100 Venezuelan migrants. They were deported to El Salvador under the wartime Alien Enemies Act without opportunities to contest allegations they were gang members. Legal experts suggest the judiciary and executive branch are headed toward a constitutional showdown. Judges' patience is wearing thin as the administration appears to be moving closer to open defiance of the court's orders.
