While it is understandable that the Biden-Harris Justice Department would want to take control of the case, it is crucial to consider the public interest and the most appropriate charging decisions.
In this instance, it is clear that the primary crime is attempted murder, which is a state crime in Florida. The state has the most straightforward and severe charges available, making it the natural choice for prosecution. Moreover, the federal government's jurisdiction is limited to specific circumstances, such as the assassination of a president or federal officer, which do not apply in this case.
The Justice Department's decision to bring federal charges against Routh, including allegations of federal firearms offenses, appears to be a power play rather than a genuine attempt to bring the most fitting charges. The alleged interstate shipment of the gun used in the attempt is a key factor, but it does not justify federal jurisdiction over the entire case.
In light of the department's earlier claims that it should not participate in cases involving Trump that could influence the election, it seems contradictory to take on this case. The department's decision to bring federal charges can be seen as a political calculation rather than a genuine attempt to ensure justice.
Ultimately, the federal government should defer to Florida prosecutors and allow them to bring the first case against Routh. The state has the most severe charges available, and its laws are better suited to handle the complexities of this case.
