Appeals Court Reconsiders Former Teacher’s Convictions

The case of a former teacher from Granite Hills High School has taken an unexpected turn after an appellate court decided to overturn some of his convictions. Gerald Lopez, who had worked as an English teacher and coach, was arrested in 2022 when a mother found texts linking her 17‑year‑old daughter to Lopez. The texts sparked an investigation that led to his arrest by El Cajon police.
In 2024, a jury in the El Cajon Superior Court found Lopez guilty of possessing child sexual abuse material and of molesting a minor. He received a suspended six‑month jail sentence and probation. Many other charges were dismissed, and the jury also acquitted him on over a dozen counts.
The appellate panel’s decision came after they reviewed the evidence presented at trial. They determined that the photograph central to the child‑sexual‑abuse‑material charge did not show the girl in sexual activity. Because of this, the conviction could no longer stand. The court also highlighted problems with how the jury heard testimony from the victim.
Jury members were allowed to listen to several days of testimony that was later judged irrelevant and prejudicial. Lopez’s defense did not get a chance to present counter‑evidence, which the court found was also inadmissible. The judge had later said that some of the victim’s statements should have been excluded because they did not relate to the charges.
The court believes that the lack of proper evidence and the mishandling of testimony led to an unfair trial. They have therefore vacated the child‑molestation conviction as well, but they found that enough evidence remains for a retrial on that count.
This ruling shows how crucial it is to follow proper legal procedures, especially when the stakes involve minors and serious accusations. The case will continue under the new decision, giving both sides another chance to present their arguments.
