Court Battle Brews Over Birthright Citizenship
Thu Feb 20 2025
A recent decision by a federal appeals court has sparked a potential showdown at the Supreme Court over birthright citizenship. The 9th U. S. Circuit Court of Appeals chose to uphold a temporary block on an executive order aimed at ending birthright citizenship for certain immigrant children. This order was issued by the Trump administration, which argued that it was a necessary step to address immigration issues at the southern border.
The appeals court, consisting of judges appointed by different presidents, decided that the case warrants a closer examination. This means the court will hear arguments in June to determine the legality of the executive order. The case is one of several legal challenges to the policy, making it the first to reach an appellate court.
The Justice Department had requested an emergency lift of the block, but the court declined. The administration argued that the order was crucial for immigration reform. However, the court saw it differently. The court stated that the order might violate the Constitution.
For over a century, the 14th Amendment has granted citizenship to anyone born on U. S. soil, regardless of their parents' immigration status. The Trump administration sought to change this by ending birthright citizenship for children of undocumented immigrants or those on temporary visas. This move was met with strong opposition, particularly from Democratic attorneys general from four states, including Washington.
The attorneys general argued that the dispute was not about immigration but about the constitutional rights to citizenship. They claimed that the president does not have the authority to deny these rights. The court agreed with this perspective, stating that the administration had not proven it would likely win the case.
Judge Danielle Forrest, a Trump appointee, wrote a separate opinion. She did not express a view on the legal arguments but noted that the administration had not shown an emergency requiring immediate court intervention. She emphasized that deciding such important issues on short notice was not ideal.
The court's decision has set the stage for a potential Supreme Court showdown. This case highlights the ongoing debate over immigration and citizenship rights in the United States.
