In a surprising turn of events, a South Korean man in his 30s found himself facing a harsher penalty after attempting to appeal his original sentence. The man was initially given a four-year probation period and a suspended two-and-a-half-year jail sentence for his role in laundering approximately $68, 000 through cryptocurrency for a voice phishing gang. Probation meant he had to regularly check in with a probation officer, while the suspension meant he would go to jail only if he committed another crime during that time.
The man, hoping for a lighter sentence, appealed to the Suwon High Court. However, his appeal did not go as planned. The higher court not only denied his request for a reduced sentence but also revoked the suspension, sending him to jail for the full four years. The court ruled that the man was not just a minor participant but a key player in the voice phishing operation, making the original suspended sentence unacceptable.
The man's role involved converting stolen funds into an unnamed cryptocurrency and transferring them to a Chinese address. The voice phishing ring he worked with would impersonate public prosecutors, calling victims to warn them about identity theft and advising them to move their money to "safe" accounts, which were actually controlled by the criminals. Once the money was transferred, it was quickly emptied.
The man's legal team argued that he had agreed to compensate the victims for their losses. However, the court was not convinced, especially given his history of involvement in similar scams. The judge noted that the man had referred to himself as "a person in charge" and had been actively involved in the day-to-day operations of the ring, even giving orders to other members.
The court concluded that the man had not learned from his past mistakes and was likely to reoffend. As a result, they deemed a severe punishment necessary to match his level of involvement. Under South Korean law, the man still has the option to appeal to the Supreme Court, which could either uphold his sentence or extend it further.
