In a shocking turn of events, a college student who was brutally raped by a club promoter on her first day of work at a trendy NYC bar is taking legal action against the business and its owner. The victim, a former dance major, filed a lawsuit in Queens Supreme Court, claiming that Blue Midtown and Dream Hospitality failed to protect her from the predator.
The incident occurred in September 2021, just two weeks after the promoter, Christopher Macias, had raped another college student. Macias, a two-time convicted rapist, was hired as a club manager and promoter, despite his questionable past. The victim described her experience, saying that she felt betrayed and traumatized by the encounter.
"I showed up as an employee, ready to work, bright-eyed and full of hope, and I left scarred, traumatized, and victimized by him," she said in an interview. "And that's at fault of these clubs and of these people that are hiring him and allowing him into a place of power. "
The victim's lawyer, Mark Shirian, emphasized the need for the nightlife industry to take responsibility for protecting its workers. "We hope this lawsuit will send a clear message to employers that they have a responsibility to protect their employees from sexual harassment and assault," he said.
The case highlights the need for greater accountability in the industry, particularly when it comes to background checks. Macias had a history of disturbing behavior, including a 2012 incident in which he was accused of shoving a police officer down the stairs in his hometown of Hoboken, NJ.
"This lawsuit aims to send a message to the nightclub industry that it has a responsibility to protect its employees," said Shirian. "Employers are liable for the actions of their supervisors in the workplace, whether they knew or should have known about their behavior. "
The victim's story serves as a stark reminder of the importance of workplace safety and the need for employers to take action to prevent such incidents from occurring.
