Idaho Pauses Abortion Referral Investigations Amid Legal Fight
Idaho, Boise, USASat Dec 21 2024
In Idaho, medical boards have agreed to put a stop to investigations into healthcare providers who refer patients to other states for abortions. This decision comes as a result of an ongoing legal battle involving Planned Parenthood and two Idaho doctors. They sued Idaho's Attorney General, Raúl Labrador, and state medical boards over a March 2023 opinion stating providers might face prosecution for out-of-state abortion referrals. Labrador later withdrew this opinion on procedural grounds.
The urgency to reach this agreement arose after it was discovered that Idaho's Division of Occupational and Professional Licenses was reviewing a complaint about an abortion referral. A patient had filed a grievance against a nurse practitioner who discussed out-of-state abortion options. However, the agency's attorney clarified that the investigation wasn't specifically about the abortion referral but an existing matter.
Planned Parenthood's attorneys, although relieved that DOPL wasn't directly investigating the referral, were still concerned. They sought a legally binding agreement to ensure that information from the new complaint wouldn't strengthen the existing investigation. Both sides eventually agreed that medical and nursing boards would not penalize providers for alleged violations of the abortion ban, and in return, the boards would be removed from the lawsuit. A judge is yet to finalize this agreement.
Despite these developments, Idaho's criminal penalties for performing abortions remain active, as does the provision allowing family members of the unborn to sue abortion providers. Recently, a federal appeals court upheld a block on enforcing Labrador's opinion while the lawsuit continues.
