Justice Beyond Wealth: A New Era for Illinois

In a landmark move, Illinois took the bold step of abolishing money bail last year, prioritizing public safety over wealth and ushering in a new era of justice and equity. This significant milestone marks a year of success, and it's time to reflect on the profound impact of this reform. The journey to this moment was long and arduous, driven by the collective efforts of stakeholders from diverse backgrounds, including public defenders, prosecutors, crime survivors, union workers, and everyday Illinoisans. Their vision of a more equitable pretrial system shaped the Pretrial Fairness Act, which was championed by lawmakers. Before the Act, money bail operated as a tool of inequality, disproportionately affecting those who couldn't afford to pay. This led to pretrial jailing based solely on wealth, with the majority of those affected being people of color. In 2019, Black people made up 50% of the jail population in Illinois, despite being only 15% of the state's population.The abolition of money bail has been a game-changer, allowing judges to make individualized decisions about pretrial release or detention. This prioritization of public safety over wealth has led to a reduction in jail populations and a decrease in racial disparities in guilty pleas. Research shows that unaffordable bonds are a major contributor to these disparities, and pretrial detention can have devastating effects on individuals, including the loss of employment, housing, and custody of children. The success of the Pretrial Fairness Act has also had a positive impact on the economy, with millions of dollars previously spent on money bonds now able to remain in communities and support economic security.
