A high court in Hong Kong recently reversed earlier fraud convictions against media owner Jimmy Lai, a move that stands out amid his ongoing legal struggles. The decision removes two years from the total sentence he faces, though it does not change his 20‑year prison term imposed under a national security law.
Lai, known for criticizing China’s ruling party and once running the now‑closed Apple Daily, has spent years in custody. His recent sentence of 20 years came after a trial that highlighted the crackdown on Hong Kong’s activists. The new ruling focuses on an earlier case where prosecutors claimed Lai’s consultancy used office space rented by his media firm, alleging fraud and lease violations.
In 2022, a lower court found Lai guilty of two fraud charges, sentencing him to five years and nine months. The judge also fined him HK$2 million, saying he hid the firm’s use of space and abused his media company as a shield. However, the appellate court determined that the evidence did not prove beyond reasonable doubt that false statements were made. Both convictions were therefore dismissed, and the defendants did not appear at the hearing.
The appellate decision slightly reduces Lai’s overall time behind bars. His national security sentence allows the two years of the fraud conviction to run at the same time, with the remaining 18 years added afterward. Critics worry that Lai could still spend his life in prison, while supporters see the ruling as a glimmer of hope for press freedom.
The case has attracted international attention, with former U. S. President Donald Trump expressing interest in helping Lai during a planned trip to Beijing. Meanwhile, the UK’s foreign secretary has called for his release on humanitarian grounds, citing Lai’s right to free expression. Chinese and Hong Kong officials defend the national security penalty as necessary for stability, emphasizing the rule of law.
Separately, another court sentenced a father to eight months for attempting to access his daughter’s insurance funds under the national security law. The daughter, an activist based in Washington, has been wanted by Hong Kong authorities and criticized the government’s actions as “utterly despicable. ” The father was found guilty of handling funds belonging to a fugitive, marking the first conviction for that offense in Hong Kong.
