Many people don't realize that the council operates separately from the larger ABA. This confusion has led some Republican-led states to consider creating their own accreditation systems. Texas has already decided to stop using the ABA's accreditation for its law schools. Florida, Ohio, and Tennessee are also looking into this.
The council insists that its decisions and finances are separate from the larger ABA. The ABA often takes public stances on legal and political issues, which can be controversial. For example, the White House has called the ABA a "snooty" organization of "leftist lawyers. " The ABA has also sued the Trump administration over various issues.
The Department of Education is even considering whether to strip the ABA council of its accreditation powers. This is due to concerns over the ABA's "diversity, equity, and inclusion" requirements.
Some experts believe that even if the council gains more independence, it might not satisfy critics. States like Texas and Florida may still have concerns about ABA accreditation.
