A heated argument is happening in a New Jersey court. Acumen Technology Solutions for Healthcare LLC wants Troutman Pepper Locke LLP to pay over $3. 5 million in legal fees. This is after Acumen proved that the law firm made big mistakes in a case that lasted seven years.
The case was tough. It included an eight-day trial and Troutman Pepper trying to blame Acumen's manager, James Dale Rangone, for their own problems. Acumen's lawyer, Dominic J. Picca, said this was unfair. He argued that Troutman Pepper was just trying to avoid paying Acumen's bills.
Troutman Pepper is fighting back. They say the fees Acumen wants are too high. The firm's lawyer, A. Christopher Young, asked the court to cut the fees by at least one-third. He said the costs to defend Rangone should not be included. According to Young, only clients can recover those fees, not third parties like Rangone.
Troutman Pepper also said the $3. 5 million is way more than the $758, 000 Acumen won in July. They questioned why Acumen's New York lawyers charged so much compared to local rates in Mercer County.
This fight is about more than just money. It's about who is responsible when things go wrong in a long legal battle. Both sides have strong arguments, and the court will decide who is right. The outcome could set an example for future cases.
