Innocence Questioned: Texas Judge Delays Execution

In a surprising turn of events, a Texas judge put a halt to the scheduled execution of Robert Roberson, a death row inmate whose innocence many advocates support. The last-minute restraining order came just 90 minutes before the execution was set to happen, after both Governor Greg Abbott and the U. S. Supreme Court declined to intervene.
Robert Roberson's daughter passed away in 2002, initially thought to be a result of shaken baby syndrome. This medical condition has been widely debated in recent years. Roberson, later diagnosed with autism, was accused of the murder because he didn't show much sadness over her death.
Those who advocate for Roberson, including the Innocence Project, argue that his prosecution was flawed. They point to unscientific evidence, misleading medical testimony, and prejudicial treatment as reasons for concern. Despite multiple appeals in state courts this week, all were denied. On Wednesday, the Texas Board of Pardons and Paroles also rejected his plea for clemency.
It was an unusual legal move by Texas lawmakers that led to the stay of execution. A committee from the state House of Representatives subpoenaed Roberson to testify about his case. They then went to a Travis County judge to request a delay.
Former detective Brian Wharton, who was part of the investigation into Roberson's daughter's death, is among those advocating for his innocence. "This is an innocent man, without a doubt," Wharton told lawmakers at a hearing on Wednesday.
This isn't the first high-profile death penalty case this year where a last-minute reprieve was sought. Last month, Marcellus Williams was executed in Missouri despite lingering doubts about his conviction. Activists tried to prevent the execution, but Republican Missouri Governor Mike Parson and the Supreme Court denied their plea.
The Texas Attorney General Ken Paxton's office, a Republican and ally of Abbott, plans to appeal to the Texas Criminal Court of Appeals to resume the execution.
