Maryland Schools Under Fire Over Gender Rules
Maryland, USAThu Jun 25 2026
The U. S. Department of Education has opened investigations into the Maryland State Department of Education and several local school districts, claiming that their policies give boys the right to use girls’ restrooms, locker rooms and sports teams. The probes were announced on the anniversary of Title IX, a federal law that protects students from sex‑based discrimination.
The Office for Civil Rights says the problem is letting students access gender‑separated facilities based only on their declared identity. It questions whether this violates Title IX and puts female students at a disadvantage. The agency wants to find out if schools are letting boys compete on girls’ teams or use girls’ bathrooms.
A complaint was filed stating that Maryland’s guidance forces schools to allow boys in girls’ locker rooms and overnight spaces. It also claims that girls must find other options if they feel unsafe, such as walking far to a single‑user restroom. The Department of Education says Title IX forbids any sex discrimination in programs that receive federal money.
The Maryland State Department of Education said it knows about the investigation and will keep up its support for all students while following the law. It offered no further comment while the complaint is reviewed.
Montgomery County Public Schools confirmed it has been notified of the probe and said it will comply with federal and state laws. The district also noted that no comment can be made until the Office for Civil Rights finishes its review.
Frederick County Public Schools called the investigation a “fact‑finding process. ” It said no fault has been found yet and that it will cooperate with the inquiry. The district warned against speculating on the outcome while the review is ongoing.
Prince George’s County Public Schools was asked for a response, but no reply came before the story was published.
The investigations raise questions about how schools balance inclusion and legal requirements, especially when students’ comfort and safety are involved. The outcome will determine whether current policies comply with federal anti‑discrimination law.
