Maine’s watchdog will look into a tactic called “red boxing” used by three Democratic candidates for governor. The commission received a complaint from an attorney who said a campaign posted a red‑boxed message that might lead outside groups to advertise for the candidate. The complainant also asked the panel to examine similar messages from two other campaigns. Red boxing is when a campaign’s website shows a box in red that contains language beyond normal policy statements. Often, it invites groups to run ads on the candidate’s behalf. He noted his experience representing both campaigns and independent groups, and he wanted to prevent coordination that could allow large dark‑money spending. The commission’s director said the red‑box tactic itself is not illegal, but it can lead to violations if an outside group spends more than the limit. He added that while federal regulators may not prosecute it, state law could still apply. When the panel meets on Wednesday, staff recommend an educational approach rather than enforcement. They may issue a warning or draft new guidance about the risks of red boxing, especially if it conflicts with First Amendment protections. One candidate’s campaign manager said they believe their tactics comply with state law and welcome the commission’s guidance. Spokespeople for the other two campaigns did not comment. The review will help clarify whether red boxing is permissible or if it could create hidden contributions that exceed legal limits.
