Should U. S. citizenship be automatic or earned?
Washington, D.C., USAMon Apr 27 2026
A new poll shows Americans mostly agree that anyone born on U. S. soil should automatically be a citizen—surprising since the Supreme Court is about to decide if that rule can change. The court is reviewing an order from early 2025 that tried to end birthright citizenship, but most people don't support that idea. Democrats almost all stand by birthright citizenship, while Republicans are split almost evenly on whether to keep or scrap it.
At the same time, the Supreme Court is handling other big cases that could reshape American life. One involves transgender athletes and whether states can ban girls who are transgender from playing on school sports teams. Most Americans seem fine with that ban, especially Republicans—while Democrats mostly oppose it. Another case questions whether mail-in ballots should count if they arrive a few days after Election Day. Most people, including many Republicans, say yes—but Democrats are far more likely to support this than Republicans are.
In a different case out of Louisiana, the court is looking at a new map of voting areas that makes two districts mostly Black, up from just one before. Many people, including Black voters, say race shouldn’t be the main factor in drawing these maps, even though they also believe neighborhoods with shared backgrounds should have representation.
The Supreme Court has made headlines lately for rulings that expand gun rights and block race-based college admissions. Its six conservative justices, including three picked by the former president, are now deciding cases that could define rights and rules for years. Public trust in the court has shifted sharply along party lines—Republicans mostly approve, while Democrats have grown more skeptical since the court overturned abortion rights in 2022.
A recent poll of over 4, 500 adults found nearly two-thirds oppose ending birthright citizenship, and over two-thirds support counting mail-in ballots that arrive late. But views depend on politics: Democrats and Republicans are deeply divided on sports bans, ballot timing, and even whether the court is doing a good job.
