Pepper-Spray Attack on Praying Uber Driver Sparks Hate Crime Charges

In the heart of New York City, a young woman found herself in trouble with the law after an unexpected attack. The incident unfolded late at night on July 31st, when 23-year-old Jennifer Guilbeault allegedly pepper-sprayed her Uber driver, a 45-year-old Muslim man, as he prayed in Arabic at a red light. The attack happened on East 65th Street and Lexington Avenue in the Upper East Side. Guilbeault was reportedly in the backseat of the car with another person when she suddenly lunged forward with a can of pepper spray and sprayed the driver’s face. The driver suffered burning, redness, and pain from the spray. Just minutes later, he called 911, leading to Guilbeault’s arrest at the scene.
Prosecutors took the matter seriously, charging Guilbeault with various crimes, including assault as a hate crime. The charges, filed in the New York State Supreme Court, include second-degree assault as a hate crime, third-degree assault as a hate crime, and second-degree aggravated harassment. Guilbeault entered a not guilty plea during her arraignment on Monday and was released with non-monetary conditions. Her next court appearance is scheduled for January 13th.

Bragg stressed the importance of protecting all New Yorkers from hate-related attacks. The spike in anti-Muslim incidents across the country, especially following the Hamas-Israel war, highlights a troubling trend. Reports from the Council on American Islamic Relations show that bias incidents have been on the rise, with 2023 seeing the highest number in the organization’s 30-year history. These incidents vary from verbal discrimination to physical assaults, impacting individuals in various settings, including the classroom and workplace.
