Plainville has found itself in a heated discussion about a nativity scene that has been a part of the town's holiday tradition for over 25 years. This year, the scene was missing, and not everyone is happy about it. The Plainville Republicans took to Facebook to express their displeasure. They believe the decision to skip the nativity scene was made by the Democratic leadership in the Town Council. The Republicans claim that no one asked for a review of the policy, and there were no complaints about the display. The Facebook posts quickly gained attention, with nearly 500 reactions and almost 150 comments. Many people expressed their support for the nativity scene and questioned why it wasn't put up this year. The town attorney, Morris Borea, explained that the question about the nativity scene came up during discussions about the town library putting up a Christmas tree. He was asked for a legal opinion and found that the nativity scene alone could raise issues with the First Amendment's Establishment Clause. This clause prevents the government from endorsing one religious belief over another.
Borea clarified that he has no personal issue with the nativity scene. In fact, he has one in front of his church. However, he believes that displaying it on town property could be seen as the government endorsing Christianity. Borea suggested two options for the town. The first is to include the nativity scene in a larger, secular holiday display. The second is to establish a policy that allows community groups to put up holiday displays, ensuring equal treatment. The Republicans suggested that adding secular decorations could have been a good solution. They also mentioned that the town council is expected to meet to establish a policy for the future. Despite requests for comments, the town council, the town manager, and the chair of the Plainville Democratic Town Committee did not respond.
