Supreme Court Justices Question Trump's Tariffs
USAFri Nov 07 2025
The Supreme Court recently discussed whether Trump's tariffs are legal. The tariffs were put in place using the International Emergency Powers Act (IEEPA) to fight the fentanyl trade and impose so-called reciprocal tariffs.
The justices seemed skeptical. The government's lawyer even admitted that a future president could use the same law to declare a climate emergency and ban gasoline-powered cars. They also said that Americans are paying part of the tariff costs, even though Trump has been saying the tariffs are bringing in lots of money.
Justice Neil Gorsuch brought up a big concern. He said the government's argument could let the White House gain power forever, taking it away from Congress. This is a big deal because it's about the balance of power between the president and Congress.
Some experts think that even the most conservative justices, like Amy Coney Barrett, Clarence Thomas, Samuel Alito, and Neil Gorsuch, might vote against Trump's tariffs. This could mean a big win against Trump, who appointed three of the justices.
But even if the Supreme Court says the tariffs are illegal, Trump's trade war won't necessarily end. There are other ways he can impose tariffs, like targeting specific industries. So, no matter what the Supreme Court decides, the trade war might continue.
Trump has warned that if the Supreme Court rules against him, the U. S. could be left defenseless. But even if that happens, he still has other tools to keep the trade war going.
