A recent decision by the Ninth Circuit Court of Appeals has brought the Theranos scandal back into the spotlight. The court rejected Ramesh "Sunny" Balwani's request for a rehearing, upholding his conviction and 13-year prison sentence. This decision came after a thorough review of the evidence, including testimony that Balwani argued was inaccurate. The court's ruling was not a surprise, as it had previously denied a similar request from Elizabeth Holmes, the former CEO of Theranos. The panel of judges clarified that even if prosecutors had failed to correct some witness testimonies, there was still enough evidence to support Balwani's conviction on all 12 counts. Balwani's defense team argued that the prosecution violated his due process rights by not correcting false testimony from two investors. However, the court disagreed, stating that the inaccuracies did not significantly impact the trial's outcome. The judges noted that other witnesses provided similar testimonies, and the jury was aware of the potential inaccuracies.
Despite the court's ruling, Balwani's attorney, Jeffrey B. Coopersmith, expressed disagreement, stating that the prosecution's failure to correct false testimony affected Balwani's rights. The government, however, declined to comment on the matter. Theranos, once a promising Silicon Valley startup, claimed it could perform numerous blood tests using a small sample. The company's valuation soared to over $1 billion in 2015 but collapsed in 2018 amid regulatory scrutiny and legal troubles. Holmes and Balwani were indicted together but tried separately due to Holmes' accusations of abuse against Balwani. Both Holmes and Balwani were convicted of investor fraud, with Balwani facing additional charges. They are currently serving their prison sentences while appealing their convictions and a $452 million restitution order. The case has been a significant one in the tech and legal worlds, highlighting the consequences of fraud and the importance of accurate testimony in trials.
