The ride‑share giant is headed back to court after a recent $8. 5 million jury award in Arizona, which many see as a warning sign rather than an isolated incident. A woman in Charlotte, North Carolina, will argue that a driver who booked her through the app touched her inappropriately and forced her to flee before 2 a. m. in March 2019. The case, expected to last three weeks, will test whether Uber’s legal status as a software company shields it from liability for driver misconduct.
Uber has repeatedly said it is not a “common carrier” like taxis, and that drivers are independent contractors. That distinction matters because it could limit the company’s responsibility for any harm caused by its drivers. Yet a jury in Arizona already found Uber liable, awarding the victim $8. 5 million in compensatory damages after a driver allegedly raped her during a 2023 ride. Uber is now asking the judge to overturn that decision or hold a new trial.
Both trials are “bellwether” cases, meaning their outcomes could influence how more than 3, 300 similar lawsuits are handled. If Uber wins again, it might keep the door open for settlements elsewhere; if it loses, it could face a wave of claims. The North Carolina case will be heard by Judge Charles Breyer, who also oversaw the Arizona trial and is currently managing a large mass litigation against Uber.
The company’s spokesperson said it had no record of the Charlotte incident until the lawsuit was filed. “Sexual assault is a serious crime that we take seriously, ” the spokesperson added, stressing Uber’s focus on technology and policies to improve safety. The plaintiff’s lawyers have not yet commented.
Meanwhile, Uber is also dealing with over 500 similar complaints in California state court. The only trial that has concluded so far there resulted in a jury finding Uber had not taken enough steps to protect the plaintiff, but that its negligence did not cause her harm. These mixed results show the legal landscape is still very uncertain for the company.
