Vermont’s lawsuit against Meta over Instagram’s design choices raises big questions about tech responsibility

The U. S. Supreme Court recently decided not to stop Vermont’s legal case against Meta, the company that owns Instagram. The state claims Instagram was built to hook young users by taking advantage of their developing brains. Vermont argues this addiction tactic boosts ad sales, especially targeting local teens. Meta, however, insists the claims are unfair because the alleged problems didn’t specifically happen in Vermont, and it never intentionally designed features just for that state.
This isn’t just a Vermont issue. Across the country, schools, cities, and states are suing social media companies. They blame these platforms for worsening mental health issues among kids and teens. Some lawsuits even say the companies knew their designs were harmful but ignored the risks. Meta faces multiple cases like this, including a big loss in New Mexico where it had to pay $375 million for misleading users about safety.
Meta’s top boss, Mark Zuckerberg, has denied that Instagram targets kids. But leaked studies suggest Instagram’s own research looked closely at how teens’ brains respond to its features. Vermont’s lawsuit also says the company hid the risks from parents and users. The state isn’t alone: 42 other attorneys general have filed similar cases nationwide.
Meta tried to get Vermont’s lawsuit thrown out. It argued that being sued in every state would be unfair and violate its constitutional rights. But Vermont’s highest court disagreed. It said if a company profits from a state’s market, it can’t avoid accountability there. The courts basically told Meta, “If you sell here and design for users here, you answer to us here. ”
Other states have already sided against Meta. Massachusetts let a youth addiction lawsuit move forward, and a New Mexico jury ordered the company to pay hundreds of millions in penalties. Even Google faced losses in cases about harmful social media designs. These rulings show a growing trend: courts are increasingly calling out tech companies for putting profits over young users’ well-being.
